Civil Litigation

Civil litigation includes any legal processes applied to resolve matters that do not involve criminal issues. It is usually between two private parties that have a claim against one another. It can take place in the courtroom, during settlement negotiations, in preliminary procedures and during appeals.


Our Attorneys have broad knowledge and experience in civil litigation in matters which are instituted in the:

  • Magistrate's Court (monetary claims less than R200,000.00); 
  • Regional Courts (monetary claims less than R400,000.00); 
  • High Courts (which have inherent jurisdiction to entertain most claims and Appeals from the Magistrate's Court); 
  • CCMA, Bargaining Councils, and Labour Courts (dealing exclusive with labour related matters, including unfair dismissals and Restraint of Trade Agreements);
  • any Appeals from the High Court to the Supreme Court of Appeal in Bloemfontein;
  • Constitutional Court.
